Article 1: Subject

These General Terms and Conditions of booking/purchase of nautical charter regulate the relationship between the Client and JammJa S.r.l.

As the owner of its advertisements, both on its website www.jamm-ja.it and on social media channels, JammJa S.r.l. undertakes to make every reasonable effort to display to the Client the available nautical charter offers matching the search parameters set by the Client.

JammJa S.r.l. does not represent either the Owner (in the event of boats not owned by the company) or the Client.

The activity of JammJa S.r.l. consists of directly connecting with Clients who request tourist services presented on its website and social channels.

JammJa S.r.l. intervenes in the conclusion of the nautical charter sales contract only in the case of direct purchase in person or through its website www.jamm-ja.it, establishing a direct legal relationship only in such cases.

In the case of services purchased through nautical rental platforms, JammJa S.r.l. is not responsible for clauses relating to booking acceptance or purchase conditions imposed by such platforms. Therefore, the Client must review the purchasing conditions of the relevant platform. In the event of booking through platforms such as SamBoat or Click&Boat, JammJa S.r.l. shall retain 30% of the purchase amount plus service charges in case of cancellation by the Client up to 48 hours before check-in.

Only in the event that the service cannot be performed for safety reasons, including adverse weather conditions, even if purchased through external platforms, JammJa S.r.l. will not retain the 30% but only the service charges.


Article 2: Description of Services

The website www.jamm-ja.it is freely accessible to all internet users interested in booking and purchasing a nautical charter and does not require prior registration. The platform lists the boat(s) registered with JammJa S.r.l. offering rental/charter services according to the search parameters selected by the Client.

JammJa S.r.l. informs users that it will make every effort to ensure regular updates of seasonal availability of the boats offered, including technical specifications and equipment. The information and photos provided are non-contractual. JammJa S.r.l. advises users, prior to boarding, to consult the skipper to carry out a full inventory. By using the portal, the Client accesses and evaluates various charter proposals. Through the JammJa S.r.l. system, the Client may receive detailed quotations for boats that meet their search criteria.


Article 3: Booking Procedure

The booking process through www.jamm-ja.it or service platforms includes the following steps:

Search and selection of the boat;

Completion of check-in in case of availability;

By completing the check-out process, the availability and price of the boat will be reserved for the Client;

Binding acceptance of the quotation and booking confirmation by the Client will be concluded only upon payment of a 50% deposit of the boat cost (only on the company website), and 100% on external platforms;

The boat will then be officially reserved in the Client’s name;

Signature of the nautical charter contract.


Article 4: Booking

The Client interested in booking a nautical charter uses the above-mentioned channels to search for the desired boat according to selected search parameters. Once the boat meeting the criteria has been identified, the Client may complete the online quotation (check-out). Availability and price will only be blocked upon payment.

Quotations issued outside the aforementioned services are valid for 10 days from issuance.


Article 4.1: Binding Acceptance of the Quotation

This constitutes acceptance of the clauses of the present contract. After completing the online quotation, if interested, the Client must formally accept the quotation. Acceptance may occur by sending a confirmation email attaching the documents requested by JammJa S.r.l. The Client thereby undertakes, with full legal effect, to finalize and sign the nautical charter contract with the Owner.

For purchases made on www.jamm-ja.it, by clicking the “Confirm Booking” or “Purchase” button, the booking will be registered.

Article 5: Deposit Payment (Only for Purchases on www.jamm-ja.it)

Immediately after booking confirmation, the Client will receive an email containing payment instructions for completion of the charter contract. Within 1 day of receipt of the confirmation email, the Client undertakes to pay a 50% deposit of the total boat cost.

Mandatory extras and optional extras will be paid directly to the charter company on the rental day or according to their instructions.

The deposit shall be paid by bank transfer to the IBAN indicated in the booking confirmation.


Article 6: Signature of the Owner’s Charter Contract

Upon payment, the Client undertakes to sign the final nautical charter contract. The Client must sign the charter contract with the Owner within 1 day of receipt. The booking/purchase shall be subject exclusively to the contractual conditions defined by the Owner.


Article 7: Use of the Boat – Liability

The use of the boat and related responsibilities are determined by the Owner in the Charter Contract.

In any case, the following rules apply:

a) In the case of bareboat rental, the Client undertakes to use the boat as a responsible skipper. In case of crewed charter, all guests must comply with the skipper’s instructions and maritime regulations. In the event of illness during navigation, stop the engine and immediately contact emergency services at 1530 (Italian Coast Guard) or VHF channel 16.

b) In the case of bareboat rental, the boat shall be used exclusively for leisure navigation, excluding commercial activities, professional fishing, transport, regattas, or other purposes unless expressly agreed with the Owner.

c) Subletting or lending the rented boat is strictly prohibited.

d) In the case of bareboat rental, the Client undertakes to embark only the authorized number of persons.

e) In the event of damage (dis-masting, hull breach, fire, etc.), the Client must immediately inform the Owner and request instructions, while also contacting maritime emergency services (1530 or VHF channel 16). A formal damage report must be drafted for insurance purposes.

f) In no case shall JammJa S.r.l. be held liable in the case of bareboat rental.


Article 8: Client Cancellation

Any cancellation before boarding must be communicated via email to info@jamm-ja.it.

Cancellation conditions are specified in the signed contract. Generally, the first deposit is non-refundable.


Article 9: Cancellation by the Owner

The Owner may cancel a booking only for objective reasons such as boat damage.

In case of cancellation by JammJa S.r.l., an equivalent or superior replacement boat will be offered. If not possible, all sums paid will be refunded without entitlement to additional compensation.


Article 10: Insurance and Deductible

Boats owned by JammJa S.r.l. are covered by full insurance (RC and hull). The Client remains liable up to the deductible amount of €800.

Insurance does not cover personal belongings.


Article 11: Liability

JammJa S.r.l. provides tourist services, excursions and events as described on its website and external platforms, but is not liable for services managed indirectly.


Article 12: Disputes

The parties agree to attempt amicable resolution of disputes. Failing agreement, disputes relating to the charter contract shall be submitted to the competent court of the place where the boat holiday took place. Disputes relating to the present booking contract shall be submitted to the court of the registered office of JammJa S.r.l.

By clicking the “accept” button, the Client confirms acceptance of these General Conditions. If the Client does not accept them, the booking cannot be completed.
